AFSPA REMOVAL!

These days AFSPA removal issue is being taken by the Kashmiri very seriously.The Chief Minister of Kashmir Omar Abdullah  is visiting all the higher authority in govt for removal of  Afspa from some parts of  kashmir.He is raising this issue from the day when he became the CM of J&K.Recently he met with Indian Prime Minister to press his demand of revocation of this law from three district.Later he met with Sonia Gandhi ,P chidambaram and Pranab Mukharjee.P Chidambaram even support his proposal infront of Media and showed confidence that AFSPA could be revoked from three districts of Kashmir. However Defence Minister A K Antony seems to be cautious on this matter and responded that matter is very sensetive and need to be handled in much mature way.Indian Army too seems to be very cautious about this issue.and clearly stated that if AFSPA is revoked from kashmir then kashmir will be independent state by 2016.
                                      1st we need to understand AFSPA.AFSPA is the special power given to Indian Army in disturbed area where the local police cannot tackle the failed administration.Under this act Army has authority to use force,arrest without warrent and search any premise  without prior permission against any individual or group in  that disturbed area.The area comes under Disturbed category when there is striking terror in the people or any section of the people, questioning or disrupting the ‘sovereignty and territorial integrity’ of India, or causing insult to the Indian national flag, the Indian national anthem and the constitution of India; etc.The governor of state  or central govt  can declare whole or any part of state as disturbed area and approved for implementing AFSPA in that region.AFSPA in Kashmir received the approval of the Indian President on the 10 September 1990.As we all know that was the time when the Kashmir valley was burning in the fire of Terrorism and seperatist feeling.There were massacar of kashmiri pandits and they were forced to leave the Kashmir.Millitants insurgency increased in large extent.The anti Indian slogans were coming from every street of valley.People were openly insulting the Indian constitution.The India Flag  could be seen burnt at every road.All the above scenario forced the Indian Govt to approved AFSPA in Kashmir valley.
                          As Soon as ASFPA implemnted in Valley.Army took the charge of state to bring back the peace process and to stop the militant insurgency from the neighbouring country.and since then they are Active in valley.In the last two decade they had done many terrorist operations and reduce the militant insurgency.To much extent they have improved the situation of Kashmir.No doubt there are many cases of Army brutality in the region.Army missuse this special act and many innocent people have been executed under this Law.The peoples dying and disappearing in Army custody often comes in the News.The ar,y interferance in personal and social life of Kashmiri's has so increased that the voice for  revoking of AFSPA is increasing day by day.
                                            These days too we hear the terror activity in valley but its less in number when compare to those days on the basis of which AFSPA was approved.People actively participate in elections.They raise their voice in support or against in the new  govt policy.They debate and discuss there problem to which is of natianal concensus.They peacefully demonstrate the issue by which they feel hurted.They  now talk about development,Trade & Higher Studies opportunities.
                                     Now the question here we have  Is  Kashmir  in  that stage from where we can withdraw the AFSPA?To this question Army as very determined answer as NO and to support it they have strong point too.Army has submitted the proper document to indian govt about lethal consequences of Revoking of AFSPA from Srinagar.Army claimed that lifting the AFSPA would provoke large-scale disturbances which, in the context of the looming withdrawal of western forces from Afghanistan and the enhanced presence of members of the Organisation of the Islamic Conference on the United Nations Security Council, would lead to Jammu and Kashmir's independence. It is being doubted that as large part of Kashmiri population raising there concern on proper availability of basic amenities in Kashmir. where as only some sections people,who are backed by ISI  raising their voice for revoking AFSPA.
                                But the fact can also not be denied that Mood of Kashmiri people are  changing  from militancy to democracy.They are raising there demand in democratic manner.Still some section of people are there who often create the tense environment But for some section of people we cannot hold the complete region under this brutual law.By looking the need of an hour Govt should bring some liberalization under this Law which reduce the authority of Army to little extent and give some power to peoples ok kashmir so that they too have confidence about the justice under AFSPA.The govt should properly analyse this Act  and should dismantle  some power of Army under this Act which is not needed today.There should be provision too under this act that amry had to clear the case of people arrested under AFSPA within a defined period of time.The proper documention should be also there under which any body can get the information about the progress of every activity under AFSPA.
AFSPA can not be removed at a time.We cannot the ignore the Army point of View because they are the one who are going to handle if the situation worsen once again.But we can libralized this Act  slowly.and according to the situation we can increase or decrease the intensity of ASPFA.

  1. Nice Write up....But I want to ask yu a question. Suppose a section of population in dhanbad becomes violent. and the government decided its time for ASPFA in Dhanbad.what will you do??? my dear friend its very easy to sit in AC .. read articles and form opinions.. but its very difficult to actually face the autocracy and interference of army in day to day matters and face the wrath of terrorist at the same time..

    There are thousands who have been murdered and labelled as terrorists.... An Army can never control and bring welfare to any state forget about Kashmir. Personally i feel we should make kashmir a separate country ... give them their freedom. after why we are still clinging on it?? just because its our national pride and ego?? hell with national pride and ego which costs me such a significant part of my financial budget.

    Kashmir is draining India's Money, Kashmir is training terrorists.... its time we should dump it and let its people decide whats best for them. Kashmir is giving us nothing but sleepless nights, draining our national income and whatever we do the presence of army is such that we will be forever blamed for such grave violations of human rights...

  2. i beg to differ from Mr greegodali, not everyone can be everywhere to feel the problem rising and by the text i just read by anish i can clearly see that he has gone through the depth of the situation gave a very tangible opinion which is way too acceptable, making kashmir a free country would be a catastrophic decision as that will certainly lead to the avalanche of pak movement within india , its not only the matter of pride ,freeing kasmir implies making india a terrorized country. nice observation anish

I appreciate your comment.One cannot deny about the brutality of Army in Kashmir.But no one was even happy with the condition of kashmir which was in 1990s.There were huge militant insurgency at that time. which was destuctive for Kashmir as well as other part of India.The terror activities were really reduced with the help of Army.The same problems are even in Northeastern part of India too.In 80s it was even in Punjab.Its completely depend upon the Govt how smartly they handle the situation.As you suggested India can Free Kashmir.Infact it is the most easiest solution for this great historical problem.It will save lots of money of India too.But the wrong Message will conveyed by this decision.The other parts who are demanding the freedom will intesify their revolution.And there will demographic uncertainity across the country.we cant even imagine what will be the situation after that.So being a responsible citizen of India.I suggested one way how we can engage the public too in the same law.So that people of Kashmir feel confidence about the justice.Its all about building trust which govt has lost some where back.......

    @Greekgodali....Quite amazing is also the fact that as soon as Mr Omar Abdullah made his hasty and controversial announcement in a public meeting [he termed it as "good news"] about the partial withdrawal of the AFSPA, grenades were showered on the few bunkers of the paramilitary force, the CRPF, in Srinagar and South Kashmir. Though the Jamiat-ul-Mujahideen, a pro-freedom militant group in Kashmir, claimed responsibility for these attacks, many pro-India politicians in the Valley, including the General Secretary of the ruling National Conference, Mustafa Kamal, raised fingers of suspicion towards the vested interests in the Army, the opposition Peoples’ Democratic Party as well as pro-freedom leaders. How come a place that was being described as the one fast returning to normalcy can all of sudden go volatile just because of one announcement made by a mercurial Chief Minister?
    whats your say on this Greekgodali if we remove army from J&K the terrorist activities in the valley will be at its fullest . and we will see it converted it into another pakistan or taliban. as per your say we should give independence to J&K and make it a free nation , dude its not about our national pride and ego its just that we consider them a part of our country. Because you know if we will free J&K either pakistan will take or china i think you must be aware of chinas military strength.

    Ya i accept with the fact that there might be some attrocities committed by the army but why are being such a pessimist why arent you looking at the positive points of what army did since its appointment in J&K in July 1990. things have changed in J&K , there has been rapid fall in the terrorist activities . i accept the fact that its people of kashmir who arte suffering from all this , many have lost there home , many fleed from there like the case of kashmiri pandits when terrorist drove them out of kashmir and acquired it was the army who maintained law and order again in kashmir. there has been a talk of relaxing AFSPA in Kashmir this can happen but we cannot take army completely out of J&K and cannot declare kashmir a free country.
